Water Quality

Water quality regulation is a highly complex area of water law with an abundance of regulatory requirements at state and federal levels.  Attorneys at O’Laughlin & Paris LLP regularly work with the State Water Resources Control Board, Regional Water Quality Control Boards, the United States Army Corps of Engineers, the United States Environmental Protection Agency, and the Federal Energy Regulatory Commission on the application and administration of the Clean Water Act and the Porter-Cologne Act on water quality compliance matters.

Representation:

  • Challenge stream listing on 303(d) list in Federal District Court.
  • Represent public agencies in challenging issuance of Total Maximum Daily Load (TMDL).
  • Represent public agencies in obtaining Waste Discharge Requirement (WDR) permits.
  • Challenge the State Water Resources Control Board’s adoption of Water Quality Control Plans at the Superior Court and Appellate Court levels.
  • Represent Modesto Irrigation District in relicensing of New Don Pedro Dam, including working with the Federal Energy Regulatory Commission and obtaining a water right certification from the State Water Resources Control Board.
  • Represent water authority in front of the State Water Resources Control Board on Porter-Cologne and Clean Water Act compliance and regulation.
